1. Scope and contracting party

These terms apply to all orders placed through the online shop matcha7.ch. Your contracting party is:

Deviating terms of the customer apply only if we expressly agree to them in writing.

2. Offer and conclusion of contract

The presentation of products in the online shop is not a legally binding offer but an invitation to order. By completing the order process you submit a binding offer to purchase. The contract is concluded when we confirm your order by email or dispatch the goods. In case of obvious errors in prices or product information we may withdraw from the contract; any payments already made will be refunded in full.

3. Prices

All prices are in Swiss francs (CHF) and include Swiss VAT. The price displayed at the time of ordering applies. Shipping costs are shown separately at checkout (see section 5).

4. Payment

We accept the payment methods shown at checkout, currently: credit cards and further methods via Shopify Payments, TWINT, and bank transfer (prepayment). For bank transfers we dispatch the goods after receipt of payment; if payment is not received within 10 days, we may withdraw from the contract.

5. Shipping and delivery

Switzerland: shipping is free for orders of CHF 35 or more. Below that, the shipping costs shown at checkout apply.

EU: shipping costs are borne by the customer and shown at checkout. Important: for deliveries from Switzerland to the EU, import charges (customs duties, import VAT) and carrier handling fees may apply in addition. These are not included in the price and are borne by the customer.

The estimated delivery time is indicated at checkout or in the order confirmation. Delays beyond our control (e.g. caused by carriers or customs clearance) do not give rise to claims for damages. For deliveries to consumers, benefit and risk pass to you upon handover of the goods.

6. Subscriptions

Our Subscription Policy additionally applies to subscriptions. Subscriptions renew automatically and can be cancelled at any time up to 48 hours before the next order date.

7. Returns and withdrawal

Our Return Policy applies: returns within 14 days for unopened, originally sealed products. Consumers in the EU have the statutory right of withdrawal, subject to the statutory exception for unsealed food products.

8. Warranty

Statutory warranty rights apply. Please inspect the goods upon receipt; obvious defects must be reported to us within 7 days (for EU consumers, the mandatory statutory periods of their country of residence apply). In case of justified defects we will, at our choice, deliver a replacement or refund the purchase price. Natural characteristics of natural products (e.g. slight variations in colour or taste between harvests) do not constitute defects.

9. Liability

We are liable without limitation for intent and gross negligence and for personal injury. Otherwise, our liability is limited — to the extent legally permissible — to the value of the affected order. Liability for slight negligence and for auxiliary persons is excluded to the extent legally permissible. Mandatory statutory liability provisions (in particular under product liability law and mandatory consumer law) remain reserved.

10. Retention of title

The goods remain our property until paid for in full.

12. Dispute resolution (EU)

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Basel-Stadt. Mandatory provisions of the law at a consumer's place of residence (including mandatory EU consumer protection rules) and mandatory places of jurisdiction remain reserved.

14. Final provisions

Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected. We may amend these terms at any time; the version published at the time of the order applies.
